This VAS BlackBerry®** Service is supplied in accordance with the Terms of Service in our Registration Form. You must comply with those Terms of Service including our Fair Use Policy and these terms and conditions. All applications for the VAS BlackBerry® Service are subject to our credit assessment and acceptance.
You must sign-up or have an existing voice plan with U Mobile. You have to pay the monthly commitment fee for the VAS BlackBerry® Service (“Commitment Fee”) as illustrated below, even if you do not use the VAS BlackBerry® Service. Charges for international roaming data services will not be part of the Commitment Fee and must be paid separately.
You must sign a contract to subscribe VAS Blackberry® Service for 24 months contract.
If you have an existing contract for your voice plan (“First Contract”) and this VAS BlackBerry® Service for a period of 24 months shall be known as the second contract (“Second Contract”) (the respective periods for the First Contract and the Second Contract are collectively referred as the “Contract Period”). The Second Contract automatically takes effect upon activation of the VAS BlackBerry® Service. You are obliged to honour both Contract Period respectively otherwise a cancellation charges (as stated below) will be imposed against you.
If you terminate or if we terminate the voice plan or VAS BlackBerry® Service because you have not complied with any of the Terms of Service in our Registration Form including these terms and conditions, during the Contract Period, cancellation charges are payable (“Cancellation Charges”)** and you must pay all outstanding charges. The Cancellation Charges for termination of the First Contract and the VAS BlackBerry® Service are calculated based on the Commitment Fee multiplied by the remaining unexpired number of months of the First Contract or the Second Contract, or both, as the case may be**.
If either we or you terminate the First Contract for any reason, the Second Contract will be automatically terminated and you must pay the Cancellation Charges for both the First Contract and the Second Contract together with any outstanding charges. If you have completed the First Contract and termination on the Second Contract takes place, the Cancellation Charges and outstanding charges will apply for the Second Contract only.
You are required to have a BlackBerry® mobile handset in order to use the VAS BlackBerry® Service. The mobile set will be bundled together with the VAS Blackberry® Service and the specifications and prices are illustrated below.
Any complaints about the mobile handset should be referred to Brightstar Distribution Sdn Bhd’s (“Brightstar”) service centres, the authorized dealer of the BlackBerry® handset, although the purchase was made from U Mobile. Brightstar’s service centres details can be viewed at this link: www.brightstarcorp.com.my. The warranty and term of use of the mobile handset will be as per Brightstar’s standard.
The maximum download speed is up to 3.6Mbps. Actual speeds will vary and are affected but not limited, by your distance from our mobile tower, the capacity of our mobile tower, the source of your download, your hardware and software and the general Internet traffic.
The VAS BlackBerry® Service charges which includes your VAS BlackBerry® Service data charges that you have selected below subject to your compliance with our Fair Use Policy. If you do not use the VAS BlackBerry® Services and data service to that value for the month, no part of this cap will be carried over to the following months. You must still pay for the use of the other Service or if you subscribe to the other Service on a subscription basis.
The international roaming data service and VAS BlackBerry® Services are each available upon request. If you wish to subscribe, you are required to apply separately. The international data roaming services and VAS BlackBerry® Services are subject to additional terms and conditions that we may impose including payment of deposits.
The VAS Blackberry® Service will continue until such date as we may decide. Nevertheless, we reserve the right to amend or change the tariffs at any time during the Contract Period as we deem fit. We will provide you with a new rate plan if you choose to continue with the VAS BlackBerry® Service when this rate plan expires. If you are not satisfied with the alternative rate plan, you may terminate this VAS BlackBerry® Service by giving us the notice.
To be an account holder you must be over 18 years of age. We are not responsible for any internet content that may be obtained via the VAS BlackBerry® Service. You must ensure that the software you use with the VAS BlackBerry®Service is properly licensed. You must not resell, share or otherwise distribute the VAS BlackBerry® Service to a third party.
We may monitor your account to ensure you are complying with the agreement. We will investigate misuse of the VAS BlackBerry® Service. If we find that you have misused this VAS BlackBerry® Service we may recover from you any costs of investigating the misuse and any compensation we are required to pay to another user or party as a result of your misuse.
You can port a phone number you have obtained from us to use with the service of another mobile service provider but you must settle all outstanding charges before you are allowed to port. If you port the phone number during the Contract Period, you must pay the Cancellation Charges and all outstanding charges.
We reserve the right to add, vary or amend these terms and conditions from time to time as we deem fit by written notice.
This rate plan cannot be combined with any other rate plans unless expressly stated.
In no event U Mobile or RIM or its employees or agents or subcontractors will be liable to you for loss of production, loss of profit, loss of use, loss of business or market share, loss of data, revenue or any other economic loss, whether direct or indirect, special or for any indirect, incidental or consequential damages, whether or not the possibility of such damages could have been reasonably foreseen and whether as a result of breach of contract, warranty or tort and the total liability of U Mobile on any claim, whether in contract, tort, or otherwise, arising in connection with the contract.
If there is any inconsistency between the provisions in these terms and conditions and the Terms of Service in the Registration Form, these terms and conditions will prevail and supersede in relation to this VAS BlackBerry® Service.
The following condition(s) specified below is to be applied for this bundle package. If there is any inconsistency with the above general terms and conditions, the below condition(s) shall take precedence:-
a. An advance payment of RM400 is to be made upon signing of this service. This advance payment will be rebated Monthly (RM 40).
b. Addition of RM68 (one month Monthly Commitment Fee) is to be made upon signing of this service. This advance payment will be treated as your Monthly Commitment Fee and will be deducted from the total bill for the subsequent month(s).
