Apple iPhone 8 Pre-order Campaign
  1. Introduction
  2. The Apple iPhone 8 Pre-order Campaign (“Campaign”) is organized by U Mobile Sdn. Bhd. (223969-U) (“U Mobile”). The Terms and Conditions and the U Mobile Privacy Policy mentioned in the website will be construed as the Terms and Conditions (“T&C”) of this Campaign on which U Mobile offers you (hereinafter interchangeably referred to as “You” or “Subscriber”) access to and use of this site for the purposes of participating in this Campaign. Subscriber agrees to comply with all the above when visiting or using this site.

  3. Campaign Mechanics
    1. This Campaign is open to existing eligible U Mobile Postpaid subscribers and new U Mobile subscribers. However, each subscriber is only allowed to pre-order for one (1) unit of Apple iPhone 8 or Apple iPhone 8 Plus.
    2. Subscriber is required to sign up for new U Mobile iPlan with an Apple iPhone 8 or Apple iPhone 8 Plus. Mobile Number Portability (MNP) request is not applicable for this Campaign.
    3. U Mobile will deliver the Apple iPhone 8 or Apple iPhone 8 Plus together with the U Mobile SIM card on 20th October 2017 onwards.
    4. Existing U Mobile Postpaid subscribers will be prompted for a SIM card replacement request during the pre-order registration.
    5. Existing eligible U Mobile Postpaid subscriber is required to follow the step-by-step instruction to provide the device IMEI no. at http://www.u.com.my/iphone-8-crp.
    6. New U Mobile Postpaid subscriber is required to follow the step-by-step instruction to activate the SIM card for the iPlan at http://www.u.com.my/iphone-8-activation.
    7. Subscriber will receive a SMS from U Mobile upon successful activation of the SIM card.

  4. Duration
  5. The Campaign will run from 13th October 2017 00:00:01 to 16th October 2017 23:59:59 ("Campaign Period"). U Mobile reserves the right to shorten, extend or cancel the Campaign Period without prior notice.

  6. Eligibility
    1. The Campaign is open to all Malaysians, 18 years of age and above (on or before 13th October 2017) except for U Mobile’s employees (and their immediate families) and its related agencies.
    2. If Subscriber is below 18 years of age, please ensure the parent / legal guardian reads and agrees to the T&C of this Campaign herein on behalf of Subscriber. It shall be deemed that the Subscriber's parent / legal guardian has agreed to the T&C of this Campaign upon the Subscriber's participation in this Campaign.

  7. Payment
    1. Subscriber acknowledges, understands and agrees to make full payment on the device price and the upfront payment for the bundle plan via U Mobile Online Store portal.
    2. Subscriber is not allowed to cancel the Pre-order or change the selected device colour upon confirmation of payment made to U Mobile.
    3. Payment made for Apple iPhone 8 or Apple iPhone 8 Plus bundle plan is not refundable or transferrable.

  8. Delivery
    1. U Mobile will deliver the Apple iPhone 8 or Apple iPhone 8 Plus on 20th October 2017 onwards to subscribers who have made full payments during the pre-order period, subject to the stock availability.

  9. Subscriber’s Covenants
    1. In connection to this Campaign and placing the Pre-order, subscriber will not use this site:
      1. If subscriber is not able to form legally binding contracts (i.e. Subscriber is under 18 years old as at 13th October 2017) unless the subscriber's parent / legal guardian reads and agrees to the T&C herein. The subscriber's parent / legal guardian will be deemed to have consented to the T&C herein upon the subscriber's use of this site and/or participation of this Campaign;
      2. to submit fraudulent order, false, inaccurate, misleading, defamatory, or libelous information;
      3. to distribute viruses or any other technologies that may harm U Mobile, or the interests or property of other users;
      4. in the event U Mobile suspects or discovers that the subscriber is abusing this Campaign and/or U Mobile in any of the ways mentioned above or otherwise, U Mobile may, at our sole discretion, take necessary steps to prevent and mitigate such abuse such as limiting, suspending, or terminating the subscriber's user account(s) and access to this site, delaying or removing hosted content, removing any special status associated with subscriber account(s), reducing or eliminating any discounts, and taking technical and/or legal steps to prevent subscriber from using this Campaign site.

  10. Limitation of Liability
    1. U Mobile uses its reasonable effort to keep its site safe, secure, and functioning properly, but U Mobile does not guarantee the continuous operation of or access to this site.
    2. Subscriber agrees that he or she is making use of this site at his or her own risk, and that it is being provided to subscriber on an "AS IS" and "AS AVAILABLE" basis.
    3. To the extent permitted by applicable law, U Mobile excludes all express or implied warranties, T&C including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
    4. Subscriber shall assume full responsibility in case of any accident, damage or claim resulting from participating in this Campaign.
    5. Subscriber shall be deemed to be able to perform legally binding contract upon his or her submission of the Pre-order & registration of a Postpaid device bundle plan with U Mobile.
    6. Warranty of the Apple iPhone 8 and Apple iPhone 8 Plus is subject to standard product warranty coverage as per T&C stated in the official Apple website at https://www.apple.com/legal/warranty/products/ios-warranty-rest-of-apac-english.html. Subscriber is advised to check the website from time to time and stay informed for any changes on the T&C of the warranty.

  11. Indemnity
  12. Subscriber will fully indemnify and hold U Mobile (and our affiliates and subsidiaries, and our and their respective officers, directors, employees, agents) harmless from any claim or demand, including reasonable legal fees, made by himself or herself or any third party due to or arising out of this Campaign or his or her breach of this T&C, improper use of the site or breach of any law or the rights of a third party.

  13. Privacy
  14. By providing your personal data, you are indicating that you have read, understood and agreed that the personal data will be recorded, stored or otherwise processed in accordance to U Mobile's Privacy Policy available at http://www.u.com.my/tnc/227.

  15. General
    1. This Campaign is strictly for Pre-order of the Apple iPhone 8 and Apple iPhone 8 Plus only.
    2. In the event Subscriber has queries with regard to the Campaign, please contact U Mobile Hotline at 018 388 1318 for clarification or more details.
    3. U Mobile reserves the right to make amendments to the T&C of the Campaign herein without prior notice.
    4. U Mobile reserves the right to disqualify any submissions for Pre-order in the event of violation of any of the T&C.
    5. In case of any dispute, U Mobile reserves the right to make the final decision and shall have the right to cancel or disqualify the pre-order necessarily.
    6. By participating in this Campaign, subscriber fully and unconditionally agrees to and accepts U Mobile's Privacy Policy as stated above, and the T&C herein.
    7. By placing an order, subscriber agrees to grant U Mobile and its respective subsidiaries, affiliates, licensees, directors, officers, agents, independent contractors and advertising / promotion agencies the use of his or her full details submitted through this Campaign in accordance to the U Mobile Privacy Policy, without further compensation, unless prohibited by law.
    8. In the event of inconsistencies between the T&C found elsewhere with regard to this Campaign (if any) and the T&C herein, the latter shall prevail.
    9. This T&C herein shall be governed by the laws of Malaysia and the jurisdiction of the courts of Malaysia.

Exclusive for U Special Customers

  1. The Apple iPhone pre-order campaign (“Campaign”) is organised by U Mobile Sdn Bhd (223969-U) (“U Mobile”) which commences from 12.00am on 13 October 2017 and ends at 11.59pm on 16 October 2017 (“Campaign Period”).

  2. By participating in this Campaign, you agree to be bound by all the terms and conditions below (“Terms and Conditions”).

  3. Campaign Eligibility
    1. This Campaign is open to all U Special customers who:
      1. are a postpaid principle line holder; and
      2. have been a U Mobile customer for a minimum period of 12 months as at 30 September 2017; and
      3. received an e-mail or SMS from U Mobile about the Campaign. “Active” means able to make and receive calls.
    2. You can check if you are a U Special customer by logging in to http://www.u.com.my/rewards/uspecial
    3. U Mobile’s employees and their immediate family members are not allowed to participate in this Campaign.
    4. U Mobile reserves the right to reject any entries or disqualify any participant without assigning any reasons.

  4. Campaign Mechanics
    1. To participate in this Campaign, you must:
      1. pre-order an iPhone 8 or 8 Plus via U Mobile’s web portal at https://www.u.com.my; and
      2. remit the relevant charges for the pre-order, during the Campaign Period.

  5. Prizes
    1. At the end of the Campaign Period, U Mobile will select the first 10 customers who complete the steps listed in paragraph 3 based on the date and time stamp of the customers completion of the steps, as the winner of the Campaign.
    2. Winners will receive 1 unit of iPhone (32GB) each.
    3. U Mobile will notify the winners of their entitlement to the prize via e-mail or SMS prior to the delivery of their pre-ordered iPhone 8 or 8 Plus. U Mobile may use any other method or medium it deems fit to notify the winners.
    4. U Mobile will courier the prize along with the pre-ordered iPhone 8 or 8 Plus to the winner’s mailing address specified in the pre-order form. U Mobile will not be held liable for any loss or damage to the prize or pre-ordered phone during the courier process. The winners must ensure that their respective Postpaid accounts are Active at the point of the delivery of the prize.
    5. The prize is non-transferable and non-redeemable for cash in full or in part.
    6. The prize is given on “as is” basis. U Mobile is not responsible for the merchantability of the prizes. U Mobile reserves the right to substitute the prize with that of similar value at any time without prior notice.

  6. General
    1. U Mobile’s decisions on any matter relating to this Campaign are final and binding on all participants. If any matters arise which are not covered in these Terms and Conditions, they will be determined solely by U Mobile.
    2. U Mobile may change any of these Terms and Conditions including terminating or suspending this Campaign and extending the Campaign Period. Any such change will be announced on our website. It is the participant’s responsibility to check these Terms and Conditions on our website and if the participant do not agree to any of the changes, they must immediately cease participation in the Campaign.
    3. All prizes are accepted entirely at the risk of the participants. To the extent permitted by law, U Mobile excludes all liability in connection with this Campaign. All participants and if the participants are below 18 years of age, their parents or guardians, agree to release U Mobile from and indemnify U Mobile against all liability (including negligence) for any personal injury, for loss or damage (including loss of opportunity) or breach of any of these Terms and Conditions; whether direct or indirect, special or consequential arising out of participation in this Campaign.
    4. By participating in this Campaign, all participants:-
      1. consent for U Mobile to collect, record, hold, store, use and disclose their personal information for purposes which are necessary or related to the participation in the Campaign; and
      2. consent for U Mobile to disclose or publish their personal information such as their names and identities and any general information that U Mobile sees fit about the participants in any media, marketing or advertising materials; and grant U Mobile the absolute and unrestricted right to modify, use and publish any still or moving images of the participants for any promotional, marketing, commercial or other related purpose, without any payment or compensation.
    5. The subscription and use of U Mobile’s Postpaid mobile services are subject to U Mobile’s standard Postpaid Terms and Condition and where applicable, these Terms and Conditions. In the event of any inconsistency, U Mobile’s standard Postpaid Terms and Conditions, as the case may be, will apply to the extent of such inconsistency.
    6. The Campaign and these Terms and Conditions are governed by the laws of Malaysia. The participants agree that the Courts of Malaysia have jurisdiction over all matters arising from this Campaign.
