These terms and conditions apply to the U BIZ M2M Plans and are to be read together with the General Terms and Conditions for U Biz Enterprise Solutions. If there is any conflict between the two, these Service-Specific Terms will prevail to the extent of such conflict.
1. Eligibility and Activation
1.1. The Plan is available to any business, company, partnership, sole proprietorship, association, society, non-governmental or government body or corporate entity with their business premises located within the Service coverage areas in Malaysia.
1.2. You must agree to the Plan proposal specified in the Order Form.
1.3. We will activate the Plan and SIM Card(s) within a reasonable time after our acceptance of your Order Form.
2. The Plans
You may subscribe to any of the following plans offered under this Service:

2.1. Individual Data SIM Plan
(a) The Individual Data SIM Plan is a data service that allows subscription to specific tiers within the individual data quota plan.
(b) The individual data quota is exclusive to the subscribing SIM Card and cannot be shared with other SIM Cards.
(c) Each data plan subscribed is subject to a Monthly Recurring Charge throughout the Service period.
(d) SIM fees are waived for all new service activations under the Individual Data SIM Plan.
2.2. Data Pool Plan
(a) The Data Pool Plan provides a shared data quota subscribed based on specific tiers, which can be used across multiple SIM Cards within the same Data Pool Plan.
(b) Data usage by each SIM under the same Data Pool Plan will be deducted from the total subscribed data quota of that plan.
(c) The Data Pool Plan supports up to a maximum of two hundred (200) or two thousand (2,000) SIM Cards, depending on the Data Pool Plan tier subscribed.
(d) SIM fees are waived for the first two hundred (200) SIMs in each Data Pool Plan. A one-time fee applies for each additional standard SIM, industrial SIM, or eSIM added beyond this limit.
2.3. Add-Ons. Add-ons may be purchased to enhance existing subscribed Plans.

3. Charges
3.1. Charges for the Plan, including any optional features, will be stated in your Order Form.
3.2. Monthly Recurring Charges apply from the Service Activation Date, even if the Service is not used.
3.3. Upon expiry of the Minimum Commitment Period, the Monthly Recurring Charges for your Plan will revert to our then prevailing pricing plan.
4. Usage Restrictions
4.1. The Plan is strictly for M2M data communication purposes only. Personal use is prohibited. In addition to our Fair Usage Policy, you shall not:
(a) tamper with, clone, or modify the SIM Card;
(b) use the SIM Card in any manner that affects our network integrity or breaches any applicable law or regulations; and
(c) engage in excessive, fraudulent, or abnormal usage inconsistent with typical M2M communication behaviour.
4.2. We reserve the right to suspend, limit, or terminate the Service if we detect any misuse, abuse, or breach of the terms of this Plan including the Fair Use Policy.
5. Term and Termination
5.1. Each SIM Card subscribed under the Plan is subject to a Minimum Commitment Period as stated in the Order Form.
5.2. If a SIM is terminated before the end of the Minimum Commitment Period, an Early Termination Fee (ETF) shall apply. The Early Termination Fee shall be equivalent to the Monthly Recurring Charge of the subscribed Plan multiplied by the remaining months in the Minimum Commitment Period.
6. Plan Modification
6.1. If you subscribe to an additional Plan, your monthly bill will include the total charges for all active Plans.
6.2. You are not allowed to upgrade, downgrade or transfer your Plan during the Minimum Commitment Period.
6.3. Any request to upgrade, downgrade or transfer your Plan during the Minimum Commitment Period shall be deemed an early termination and subject to the Early Termination Fee.
6.4. After the Minimum Commitment Period ends, you may upgrade, downgrade or terminate your Plan by contacting your Account Manager.
7. SIM and mobile number
7.1. We own the SIM at all times. You have no legal interest, rights or goodwill to any mobile number or PIN assigned to the SIM.
7.2. You must keep the SIM safe and in good condition and return the SIM to us upon request, including when this Agreement ends or if the SIM is upgraded, modified or replaced for operational reasons.
7.3. You must not sell, distribute or reproduce the SIM and must take all reasonable precautions to prevent its loss, theft or misuse.
7.4. You may be charged for any SIM replacement, except in cases where the replacement is due to a verified manufacturing defect. In the event of theft or loss, you remain liable to pay for all fees and charges incurred through the use of the Service.
7.5. We may withdraw or change any mobile number for commercial, operational or technical reasons or in compliance with any requirement of the regulatory authority and we will endeavour to give you reasonable notice in this event.
7.6. You are responsible for managing and monitoring the usage of all SIMs.
7.7. You may contact your Account Manager for any SIM-related support.
7.8. You remain liable for all Charges under your Plan(s) and any Add-Ons until the Service is officially deactivated.
8. Definitions
In these Terms, when we say:
8.1. “Account Manager” refers to the dedicated representative for your U BIZ M2M account, assisting with service queries. Contact details of your Account Manager will be shared upon activation and may be updated from time to time.
8.2. “Add On(s)” means additional services that can be purchased to enhance the existing subscribed Plan(s).
8.3. “Data Pool” means the data sharing pool of the total allocated data quota across all active SIM Cards within the same Plan.
8.4. “Device” means any equipment or hardware that uses the M2M SIM Card for connectivity.
8.5. “End User(s)” means your employee or agents or any person using the SIM Card or the Services provided to you.
8.6. “M2M” means Machine-to-Machine communication using a SIM card to transmit data between devices.
8.7. “Minimum Commitment Period” is the pre-agreed duration for which you are required to subscribe to the Services as specified in the Order Form which shall commence from the Service Activation Date of the SIM Card.
8.8.“Monthly Recurring Charge” means the fixed charges that you must pay every month for a subscribed Service.
8.9. “Order Form” means to any of our official document used to confirm your request to us to supply a specific service to you, such as a Service Order Form (SoF), Electronic Registration Form (eRF), or a customer-approved quotation.
8.10. “Plan(s)” refers to the subscribed U BIZ M2M SIM plan or U BIZ M2M Data Pool plan or both (as the case may be), including its respective data quota, fees, and features. This does not include the Add Ons.
8.11. “Service Activation Date” means the date that we activate your SIM Card for your use.
8.12. “SIM Card” means the subscriber identity module issued under this Plan.
8.13. “You” or “your” means the corporate customer or company holding a U BIZ M2M account, including your employees or agents or any person, who are authorised to use or manage the subscribed SIMs or the Services under this Service-Specific Terms and Conditions.
