ULTRA5G Reserve Terms and Conditions
A. These Terms and Conditions are the terms and conditions on which we supply ULTRA5G Reserve (“ULTRA5G Reserve” or “Service”) to you.
B. The Service is provided to you as a bundle with our rate plan or as an add-on to a service or product (where made available).
C. By subscribing to ULTRA5G Reserve you agree to be bound by these Terms and Conditions, together with our General Postpaid Terms of Service, Privacy Notice and the terms of the applicable rate plan, which are all available at
www.u.com.my.
1. Service Description
1.1 ULTRA5G Reserve is an advanced 5G service designed for differentiated performance by providing prioritised data performance and access on our ULTRA5G Standalone (“SA”) network, during periods of high network usage.
1.2 The Service provides prioritised traffic handling and enhanced network resource allocation within the ULTRA5G SA network.
1.3 The Service does not provide a dedicated private network, leased line, guaranteed bandwidth service, or service level agreement (SLA)-based offering.
2. Eligibility
2.1 ULTRA5G Reserve is only available (i) if your subscribed rate plan is eligible for it, or (ii) as an add-on subscription for eligible services, as communicated by us from time to time.
3. Experience and Performance
3.1 ULTRA5G Reserve is available exclusively on our ULTRA5G SA network.
3.2 The prioritised traffic handling provided under ULTRA5G Reserve applies only when your device or router is connected to our ULTRA5G SA network.
3.3 If your device is outside our ULTRA5G SA coverage or if your device connects to 4G, Non-Standalone 5G (“NSA”), or any other network configuration, prioritised traffic handling will not be available. “NSA” means a type of 5G that relies on the 4G network to operate, instead of using a fully independent 5G network.
3.4 During periods of high network usage within the same coverage area, ULTRA5G Reserve is designed to deliver prioritised data performance of up to four (4) times higher compared to data performance delivered to customers who are not subscribed to ULTRA5G Reserve. However, actual speeds, latency, and overall performance may vary and are subject to factors including but not limited to:
• Network conditions and traffic demand;
• Network site capacity;
• Distance from network infrastructure;
• Physical obstructions and environmental factors; and
• Device or router capability.
4. Access and Device Requirements
4.1 In order to access and enjoy ULTRA5G Reserve, you must, at all times:
(a) subscribe to an eligible rate plan or purchase the Service as an add-on, as applicable; and
(b) be within coverage of and connected to our ULTRA5G SA network throughout the time of usage; and
(c) use a 5G Standalone (SA)-capable device or a 5G SA-compatible router; and
(d) use a valid and compatible SIM that can access our ULTRA5G SA network.
4.2 We are not responsible for your inability to access or degradation of ULTRA5G Reserve arising from device or router incompatibility, unsupported firmware, hardware limitations, SIM configuration, or other technical issues.
4.3 For certain devices, including selected Apple iPhone models, access to the ULTRA5G Standalone (SA) network may require a SUCI-enabled SIM. You are responsible for ensuring that your SIM and device configuration meet our technical requirements for ULTRA5G SA access. “SUCI-enabled SIM” means a SIM card that supports Subscription Concealed Identifier (SUCI), which securely protects your identity when connecting to a 5G Standalone (SA) network.
5. Suspension and Termination
5.1 Where ULTRA5G Reserve is bundled within a rate plan or subscribed as an add-on, if your rate plan, underlying service or product is suspended or terminated, the Service will also be suspended or terminated automatically.
6. Disclaimer
6.1 ULTRA5G Reserve is provided on an “as-is” and “as-available” basis without any service level assurance (whether express or implied). We disclaim all liability in relation to the Service including but not limited to the availability, accessibility, timeliness, continuous and uninterrupted use of the Service or secured access to the Service.
6.2 We are not liable for any loss of profits, data, revenue, business or anticipated savings (whether direct, indirect, special or consequential), or for any other special or consequential loss or inconvenience that may arise directly or indirectly from or in connection with your use of, reliance on, or inability to use the Service, including service interruptions or compatibility issues.
