  1. General
    1. U Mobile Trade-In Programme is a device trade-in programme (“Programme”) provided by U Mobile Sdn. Bhd. Registration No. 199101013657 (223969-U) (“U Mobile”) and operated by Bolttech Device Protection Malaysia Sdn. Bhd. 200601030522 (750280-K) (“Bolttech”).
    2. If you participate in this Programme, these terms and conditions including our Privacy Notice, will apply (collectively, the “Terms”), all of which are available on www.u.com.my.

  2. Eligibility
    1. This Programme is open to all individuals who are:-
      1. citizens or permanent residents of Malaysia; and
      2. at least 18 years of age;
    2. You are not eligible to participate in the Programme if:-
      1. Your Device is unable to be switched on;
      2. Your IMEI is unreadable;
      3. Your Device is subject to a device contract commitment period which is still subsisting. If we agree (at our absolute discretion and option) to allow you to trade-in your Device which is still subject to such a contract commitment period under the relevant device contract with us, you must pay early termination charges and fees in accordance with the relevant terms and conditions for the device contract before you are allowed to participate in the Programme;
      4. Your Device is under a contract commitment period with other service providers or third parties, you must check with the relevant parties before participating in the Programme.
    3. In order to be eligible for trade-in, your Device must not be defective and is in working condition i.e. no major cracks or smashed screen, no swollen battery, no account locks.
    4. The list of the device model eligibility and diagnostic checks for buy-back and trade-in under the Programme can be found from the Programme website (“Trade-In Portal”) at https://umobile-tradein.bolttech.my/my/TradeIn which is hosted by Bolttech. The list of Devices may be updated by U Mobile and Bolttech from time to time. We reserve the right at our sole discretion, to reject any Device, and the decision is final and not subject to any appeal.

  3. Online Trade-In Process and Payment
    1. To participate in the Online Trade-In process, you must visit the Trade-In Portal at https://umobile-onlinetradein.bolttech.my/my/onlineTradeIn/select-device. You are required to select your Device make, model and capacity from the dropdown menu in the Trade-In Portal and also provide your Device IMEI/Serial number. You will be required to declare your Device condition via the Trade-In Portal.
    2. Bolttech will evaluate the condition of your Device based on the information you have declared and provide you with the estimated trade-in value for your Device. If you accept the estimated trade-in value shown on the Trade-In Portal, you may complete your trade-in request by providing the address for collection of the Device. You will be issued with a trade-in confirmation email that will reflect the estimated trade-in value.
    3. Bolttech will arrange for the Device collection and provide you with the details of the Device collection via email. Bolttech’s courier agent will collect the Device from your collection address and the Device will be inserted into a sealed pouch for safety reasons. You are required to sign on the Device handover document. The courier agent will then deliver the collected Device to Bolttech’s office.
    4. Collection and delivery timelines for collected Device may vary according to your location and shall be based on Operating Timelines.
    5. Bolttech’s staff validate the condition of the collected Device against the information you have declared in the Trade-In Portal. If your Device matches with the IMEI/Serial number and the condition that you have declared, Bolttech will process the payment to be transferred into your bank account within two (2) Business Days.
    6. If the IMEI/Serial number of the Device does not match with the information provided on the Trade-In Portal, you will be contacted by Bolttech and the Device will be returned to you.
    7. If the Device condition does not match the declaration that you provided on the Trade-In Portal, the Device condition will be reassessed, and you will be contacted by Bolttech to offer you a revised trade-in value (“Revised Trade-in Value”).
    8. If you accept the Revised Trade-in Value, Bolttech will process the payment to be transferred into your bank account within two (2) Business Days. If you do not accept the Revised Trade-in Value, the Device to be returned to you.

  4. U Mobile Stores Trade-In Process and Payment
    1. To participate in this Programme, customer can walk in to U Mobile Service Centres, provide us with your Device and personal information. Our Service Centre representative will check the physical condition of your Device and network locking status and assist you in the web-based trade-in process. After running the device diagnostic on the Device via the Trade-In Portal, you will be required to declare the physical condition of your Device for Bolttech to provide the quotation for your Device.
    2. During the process, you are required to remove the screen protector on your Device for us to accurately evaluate your screen condition. If you decide not to proceed with trade-in subsequently, we will not be liable for the replacement of the Device screen protector.
    3. Upon your acceptance of the trade-in value, you must hand over your Device to us. You are allowed to trade-in a third party’s Device provided that you present an authorization letter which must include the following details and supported by a copy of the authorizing party’s NRIC or Passport for verification purposes:
      1. Full Name and NRIC/Passport number of (a) the owner of the Device and (b) the authorised person to handle the trade in.
      2. Device Details: Make, model, and IMEI/Serial number of the Device.
      3. Statement of Authorization: A clear declaration that the owner authorizes the recipient to trade in the specified Device on its behalf.
      4. Signature of the authorizing party (owner of the Device).
    4. Bolttech will pay the accepted trade-in value via bank transfer to the bank account number that you provide us within two (2) Business Days.

  5. Personal Information
    By providing your personal information or participating in this Programme, you acknowledge you have given us your consent to collect, record, hold, store, use and disclose your personal information for purposes which are necessary or related to the provision of Programme (a) via the Trade-In Portal by Bolttech according to Bolttech’s Privacy Notice which is available at Service Portal (bolttech.my) and (b) any other means according to U Mobile’s Privacy Notice which is available at https://www.u.com.my/en/personal/support/terms-conditions/others/privacy-notice.

  6. Indemnity and Limitation of Liability
    1. You agree to indemnify U Mobile and Boltech, its respective directors, officers, employees, affiliates or agents from and against any claims brought against any of them in connection with the performance of the Programme and release us from any claims, losses or damages that may arise with respect to it.
    2. You agree to indemnify us, our employees and officers against all loss, damage, liability and expenses incurred by us or them due to or as a result of any claim made or legal proceedings for defamation, infringement of intellectual property rights, theft, conversion, obscenity, property damage, personal injury or death or breach of any law or regulation brought against us or them in relation to your participation in the Programme or due to your act or omission in participating in this Programme.
    3. We will not be liable for any loss or damage to your Device during the trade-in process. You are responsible for backing up your data, contacts, photos, messages, music, (content) removing any personal information or content from your Device and resetting your Device to its factory settings before surrendering it to us. Data recovery or data backup is not a part of the Programme; accordingly we accept no responsibility or liability for any loss of content, files or data in the Device that you have traded-in.
    4. We will not be liable to you or to any persons claiming through you for any costs, loss or damage (whether direct or indirect), or for loss of revenue, loss of profits or any special or consequential loss including loss of profits, data, revenue, business and anticipated savings of any nature whatsoever including but not limited to the following:-
      1. your participation in the Programme for whatever reason, the information available via the Programme or arising out of any action taken in response to or as a result of such information available via the Programme;
      2. any act, omission, error, default by us and/or our related companies, its officers, employees, agents and partners in relation to the Programme;
      3. any claim for libel, slander, infringement of any intellectual property rights arising from the transmission and receipt of material in connection with the Programme and any claims arising out of any of your act, omission, negligence or default in relation to any part of the Programme.

  7. Disclaimer
    1. You acknowledge that the Trade In Programme is provided on "as is" and "where is" basis without any warranty or guarantee of any kind, whether express or implied. We do not make any representation and disclaim warranties of any kind in relation to the Programme and we also disclaim all implied warranties of merchantability, fitness for a particular purpose and non-infringement to the fullest extent allowed by law.
    2. We do not warrant the continuity, uninterruptible and/or error-free of the buy-back and trade-in service operated and managed by Bolttech under the Programme and we expressly disclaim any representations or warranties of title, non-infringement, merchantability, usage, fitness or technical function in relation to or any information contained in the Trade-In Portal.

  8. Your Responsibilities
    1. You represent and warrant that you are authorised to trade in your Device to U Mobile and Bolttech and that you are the rightful owner of the Device and have the legal right to sell it to us. You agree to indemnify and hold us harmless from any claims or damages arising out of any breach of this representation and warranty. Upon Bolttech accepting the Device, title of ownership in such Device directly transfers to Bolttech through U Mobile and you disclaim any further right, title or interest in and to the Device.
    2. You agree to provide true and accurate information including but not limited to: the information of the make, model and condition of your Device, your full name, bank name, bank account number, NRIC or passport number and address via the Trade-in Portal.
    3. You agree that the Device that you submitted will not be returned to you, and that any contents in the Device cannot be recovered.

  9. Amendments
    U Mobile may change any of these Terms and Conditions including terminating or suspending this Programme. Any such change will be announced on our website. It is your responsibility to check these Terms and Conditions on our website. In the event of such termination, all trade-ins completed prior to the termination date will still be fulfilled under the terms of Programme.

  10. Fraudulent Activity
    We reserve the right to reject any Device or transaction that we suspect to be fraudulent, stolen or illegal. We may also report any suspicious activity to the relevant authorities.

  11. Matters Beyond Our Control
    We do not guarantee or warrant that the Programme will be free from any fault, error or interruption, due to matters beyond our control. We will not be liable for any inability to participate in the Programme, interruption or disruption of the Programme, delay or failure resulting from matters beyond our control. These include acts of God, requirements of any governmental or regulatory authority, war, national emergency, accident, any natural disasters such as fire, flood, earthquake, equipment failure, computer or software malfunction, electrical and power failure, fault, interruption or disruption of our network, or of your Device, equipment or the equipment of any third party, riot, strikes, lock-out, industrial dispute (whether or not involving our employees) or epidemics of infectious disease.

  12. Miscellaneous
    1. These Terms contains the entire agreement between you and us and supersedes all prior agreement, undertakings, negotiations and discussions between us.
    2. If any of the terms in these Terms are not valid or legally enforceable, the other terms will not be affected.
    3. The laws and courts of Malaysia will govern these Terms. Any processes or judgment may be served on you in the same way as the notices.
    4. If there’s any conflict between these Terms, your application and terms in other documents which are expressly agreed to form part of the Agreement, the conflict will be resolved in the following order: these Terms, your application and terms in other documents.

  14. Definitions and Interpretations
    “Device” means mobile connected device such as mobile phone.
    “Operating/Delivery Timelines” means Business Days, which means Monday to Friday 9AM to 6PM, excluding public holidays in Kuala Lumpur, Malaysia.
