General
a. The Prepaid iPlan is a bundled service with an iPhone device and are each a 30 day bundled service for local voice calls, local SMS and data supplied according to the U Mobile Prepaid Terms and Conditions. You must comply with those terms including our Privacy Policy, the relevant iPlan and these additional terms and conditions (collectively, the "Terms") all of which are available on www.u.com.my/tnc.
b. The iPlan is available to new customers, existing customers and those who port-in from other service providers.
c. We reserve the right without liability to modify or otherwise change these Terms at any time including the charges.
d. The iPlan cannot be combined with any other offers unless expressly stated.
e. The iPlan is available until withdrawn by us.
f. If you are an existing U Mobile Prepaid customer and you sign up for a Prepaid iPlan, you may retain your phone number. Any remaining SMS, voice minutes or data allowance to which you are entitled under the previous prepaid plan will be forfeited and any content subscription services which are part of your previous prepaid plan will be automatically terminated. However:
i. If you sign up for a Prepaid iPlan, any credit remaining may be carried over to your new Prepaid iPlan up to a maximum value of RM2,000. Any credit balance exceeding the sum of RM2,000 will be automatically forfeited.
Activation and Charges
a. When you first sign-up you must make a payment of RM159 which comes with a top up credit of RM159. Your initial top-up will be valid for 200 days. We will deduct the monthly fee from your credit balance whether or not the activation was authorized by you. No refunds or request for credit will be entertained.
b. Upfront payment is required upon registration. This upfront payment will be rebated over 24 months from activation or 24 times whichever occurs earlier. The rebate will reduce your monthly fee and given upon each renewal. If you terminate or if your iPlan expires before the expiry of the 24 month period or before you have enjoyed the rebate 24 times (as the case may be), your remaining monthly rebates will be forfeited.
c. The validity period is 30 days from the date of activation. On its expiry, your subscription will be automatically renewed only if you have sufficient credit balance prescribed by your iPlan for you to enjoy your monthly rebate. If the renewal fails, your iPlan will expire and any unused data allowance, voice minutes or SMS will be forfeited. Your iPlan will be automatically renewed based on your immediately preceding iPlan once you top-up or have sufficient credit balance in your account.
d. If your iPlan sets out a maximum amount of data, voice minutes or SMS, any unused data allowance, voice minutes or SMS expires each month and cannot be rolled over for use and will be forfeited.
e. When your iPlan expires you will be charged our standard “pay-as-you-use” rates for data, voice minutes and SMS.
f. iPlan is based on domestic usage. Charges for services not listed, such as MMS, video calls, IDD, international roaming including data roaming, content subscription services, call forwarding and special numbers e.g. 1300 or 1800 numbers are charged separately based on our standard rates or the current roaming charges as determined by our roaming partners. They are not included in your iPlan and will be separately chargeable and deducted from your credit balance.
g. If you have exceeded the allocated voice minutes or SMS under the Prepaid iPlan, we will notify you via SMS or you can check your balance at any time by dialling*118#. However, you are not entitled to any refund or credit if we fail or delay in sending you the SMS notification.
h. You will continue to be responsible for all other current and future taxes including stamp duty and any other charges imposed by law in connection with the Services or the preparation of the Agreement. If we are required under any law to deduct or withhold any sum as taxes imposed on any amount payable to us, the amount payable to us will be increased by such amount necessary to ensure that we will receive a net amount equal to the amount which we would have received in the absence of any such deduction or withholding.
Voice & Data Service
a. All voice minutes bundled shall be used strictly as part of normal everyday mobile voice usage for individual customers. The Service shall not be:
i. re-sold, rented or utilised in any other way;
ii. used for multiple simultaneous calling, conference calling, re-supply, call centre usage, telemarketing, application-to-person communication, continuously call forwarding, auto-dialing, machine-to-machine communication;
iii. Used for wholesale or for SIM boxing or aggregate minutes on our network;
iv. used in connection with a device, software or application which re-routes calls;
v. used to set up switch devices which could keep a line open potentially for hours and limiting the ability for other customers to access our network; or
vi. used for any other activity that U Mobile deems to be non-standard usage.
b. All voice minutes bundled only apply to domestic mobile/fixed on-net & off-net usage and excludes video calls, IDD, International Roaming or calls to special numbers/premium numbers (e.g.: 1300/1500/1508/1600/1700/1900/103, 1311, 800 & 15999) and 02-prefix numbers for border calls to Singapore and 080-prefix numbers for border calls to Brunei.
c. U Mobile at its sole and absolute discretion reserves the right at any time without being liable to you to suspend or terminate the service if you are found to be in violation of the Terms.
d. If you exceed your allocated voice minutes we will charge you 5 sen/30 seconds to all networks.
e. Your allocated call credit will be deducted based on the duration of your calls and are charged based on 30 seconds block.
f. Even if your iPlan does not have any limit on the data usage, you must not use our services in a manner that we consider ‘unreasonable’ or ‘unacceptable’, including, but not limited to `non-ordinary’ or `commercial purpose use’ of this iPlan. For clarity, we consider peer to peer file sharing to be ‘unreasonable’ use as this will congest our network resources and affect your browsing experience as well as that of our other customers.
g. Your actual download speed and data capacity will vary and may be slower and are affected but not limited, by your distance from our mobile tower, the capacity of our mobile tower, the source of your download, your handset type and quality, the general Internet traffic and coverage availability. If your total download and upload use per month exceeds any applicable allocated data allowance, we will manage your bandwidth by reducing your speed.
h. Your data use will be counted in MB increments.
i. For SMS, if you exceed your SMS entitlement, we will charge you 3 Sen/SMS to U Mobile network and 8 Sen/SMS to other networks.
Apple iPhone Device
a. We do not make any representations or give any warranties whether express or implied relating in any way to the device that you buy from us or from our dealers as part of the iPlan nor do we warrant the performance or suitability of that device on our network. If you have bought any devices or accessories from us or our dealers, we are not responsible for replacing the device or any part of the device that is lost, stolen, damaged or defective. All claims relating to those products are covered by the warranty, if any, offered by the manufacturers. The terms and conditions of this warranty are set out in the documentation that you receive when you accept your device. Any complaints or warranty claims must be referred to the manufacturer and are subject to that manufacturer’s terms and conditions.
Upgrading or downgrading your iPlan
(Applicable only to customers who have subscribed to Prepaid i60, i90 and i130 plan before 26th October 2018)
a. Existing Prepaid i60, i90 and i130 plan customers are applicable for Prepaid iPlan monthly auto-renewal if the credit is sufficient.
b. If the auto-renewal of the Prepaid iPlan is unsuccessful due to insufficient credit in the account, customers are still be allowed to retain the existing Prepaid plan after customer has sufficient credit for auto-renewal.
c. If Prepaid iPlan auto-renewal is unsuccessful due to account being passive mode status, customers are not allowed to retain back the existing Prepaid iPlan even after the account has become active as Prepaid i60, i90, i130 plan will be discontinued on 26th October 2018 onwards. Hence, the only option available is Prepaid i40 plan.
