CREDITSOS TERMS AND CONDITIONS


1. CreditSOS is a service that allows an eligible U Mobile Prepaid subscribers to receive advance prepaid credit from U Mobile when the subscribers have low or insufficient credit or on an emergency basis (“Service”).


2. By subscribing to the Service, you agree to these terms of service and the terms applicable to the relevant U Mobile Prepaid terms and conditions including our Privacy Notice, all of which are available on https://www.u.com.my/en/personal/support/terms-conditions (collectively, the “Terms”).


3. Eligibility


3.1. The Service is made available to all U Mobile Prepaid subscribers who have subscribed to U Mobile Prepaid for a minimum tenure of 30 days based on your eligibility as determined by U Mobile.


3.2. Your eligibility is determined by U Mobile based on factors which include but is not limited to account status, usage, top-up pattern, repayment history, outstanding amount, fraud or misuse concerns and other reasonable operational or risk factors.


3.3. Meeting the minimum tenure requirement does not automatically qualify a subscriber for CreditSOS.


3.4. You are allowed to subscribe to more than one (1) CreditSOS at a time subject to your eligibility at the time of subscription request as determined by U Mobile.


4. Service Subscription and Fees


4.1. The Service involves the CreditSOS credit advance amounts (“CreditSOS amounts”) which are subject to the service fee and validity options as set out below:

4.2. The CreditSOS amount offered or approved will depend on the subscriber eligibility at the relevant time as determined by U Mobile.


4.3. The maximum validity of each CreditSOS will be three (3) days.


4.4. Automated CreditSOS


(a) If you activate Automated CreditSOS, you authorise U Mobile to automatically grant CreditSOS when your prepaid balance reaches the threshold set by U Mobile (“threshold value”), subject to eligibility.


(b) The amount granted may vary each time.


(c) Automated CreditSOS can be deactivated at any time using the prescribed SMS or UMB channel.


5. How to Subscribe or Request


5.1. CreditSOS may be obtained:


(a) By subscriber request;


(b) Through Automated CreditSOS; and/or


(c) Through an offer sent by U Mobile


5.2. Subscriber may

Note:


“Active" means able to make and receive call.


“Passive" means not able to access the internet, make outgoing calls and SMS.


6. Repayment


6.1. The repayment of the CreditSOS amount and service fee (“Outstanding Amount”) will be automatically deducted from your next Prepaid top-up.


6.2. If your Prepaid top-up amount is insufficient to cover the Outstanding Amount, the remaining balance of the Outstanding Amount will be deducted from your subsequent Prepaid top-up, until the Outstanding Amount is fully repaid.


6.3. If you have Outstanding Amount from more than one CreditSOS subscriptions, your Prepaid top-up amount will first be utilised to settle the Outstanding Amount of your earliest CreditSOS subscription, followed by the Outstanding Amount of your subsequent CreditSOS subscriptions.


6.4. Any airtime received through CreditShare will not be used to offset any outstanding CreditSOS amount.


7. Validity and Expiry


7.1. Each CreditSOS amount is valid only for the validity period stated when it is granted.


7.2. Any unused CreditSOS amount will expire and be forfeited after the validity period ends.


7.3. Expiry of unused CreditSOS does not remove your obligation to repay the full outstanding amount.


7.4. Your prepaid account validity may be extended if the CreditSOS validity is longer than your remaining account validity, subject to U Mobile’s prepaid validity rules.


Example: If the validity period of your Prepaid account is until 20 March 2020, and you subscribe to a CreditSOS of RM5 (with a validity period of 2 days) on 18 of March 2020, the new expiry date of your Prepaid account will be 18 March 2020 + 2 days = 20 March 2020.


However, if the validity period of your Prepaid account is until 20 March 2020, and you subscribe to a CreditSOS of RM5 (with a validity of 2 days) on 10 March 2020, there will be no adjustments to the expiry date of your Prepaid account.


7.5. Your CreditSOS balance will expire and will be forfeited if you switch to other U Mobile Prepaid plans or if you port out to other telecommunication operators.


7.6. You will be required to settle all Outstanding Amount if you wish to terminate your U Mobile Prepaid account or switch to other U Mobile Prepaid or Postpaid plan.


8. Fess, Refunds and Charges


8.1. The service fee is charged once CreditSOS is successfully granted, whether or not the credited airtime is fully used.


8.2. No refund or reversal will be given after successful granting of CreditSOS.


8.3. SMS requests made in Malaysia to the designated shortcode are not charged unless stated otherwise.


8.4. If you subscribe for the Service via SMS when you are in Malaysia, there is no charge for the SMS. However, any subscription to the Service via SMS while roaming, the SMS will be charged. The charges will depend on the roaming countries and operators that you have selected. 9. Change, Suspension and Withdrawal


9.1. We may amend these Terms or suspend, modify or withdraw the Service (including any of its features and functionalities) at any time and any of these Terms from time to time. Any change of these Terms will be announced on our website. It is your responsibility to check the Terms on our website.


9.2. We may stop allowing you to use the Service, with or without notice for any reason whatsoever, including if we suspect that there is fraudulent or unauthorized use or for any operational reasons.


9.3. U Mobile may send CreditSOS-related notices by SMS, app notification, website posting or other official communication channels.


9.4. If you believe there is an error in any CreditSOS transaction or deduction, please contact U Mobile as soon as reasonably possible.


10. Liability


10.1. We shall not be liable for any loss, damage, or delay arising from (i) the use or inability to use the Service, (ii) interruption or unavailability of the Service or (iii) the suspension or termination of the Service for any reason whatsoever.


11. General


11.1. These Terms are governed by the laws of Malaysia. You agree that the Courts of Malaysia have jurisdiction over all matters arising from these Terms.


11.2. If there is any conflict between these Terms, the Prepaid plan terms and conditions and the privacy notice, the conflict will be resolved in the following descending order:


(i) The Prepaid Plan Terms and Conditions;


(ii) The Privacy Notice; and


(iii) These Terms


11.3. References to “us”, “our” or “we” mean U Mobile Sdn Bhd Registration No. 199101013657 (223969-U).
